PERSONAL HUNTING OPTION AGREEMENT 1. Exclusive year-round hunting privileges of all seasons for the blind and feeding area (as presently laid out) of your choice in the House Pasture. Feeding area shall be defined as the immediate 300 yard radius from the feeder not to cross a property boundary fence. 2. Game animals to be hunted in this agreement are white-tailed deer (bucks and does), Rio-Grande turkeys (fall and spring seasons) and feral hogs year-round. No white-tailed fawns or exotics shall be hunted. 3. The total kill limit each year will be limited to a full license tag for one hunter plus one buck of the hunter’s choice. Four pointers and ‘nubbin’ bucks are not permitted. 4. The purchaser of this option may sell part or all of the terms of this agreement to another party. The rancher must approve the purchaser of a full sale of this agreement before a transfer of ownership is completed. The rancher does not need to approve other hunters who purchase short-term or partial hunting rights from the owner of this option agreement. All proceeds of partial or full sales of this agreement belong to the option agreement owner. 5. This agreement shall be for a length of four (4) full years beginning February 1, 2009 to January 31, 2013. All terms of this agreement shall end at sundown on January 31, 2013. 6. The total cost of this agreement shall be $24,000.00 and shall be paid in full February 1, 2009. If desired, an individual may purchase a second option agreement for an additional blind and feeding area of his choice in the House Pasture at the same price of $24,000.00 with the same terms as this agreement and can be operated either separately or jointly. 7. The ranch will provide a livestock-proof fence around the feeding area for the full term of the agreement. If desired, the ranch will “put out the feed.” The feed type and amount will be selected and paid for by the hunter. Feeding frequency and “filling cycles” will be mutually agreed upon by both the hunter and the rancher. The ranch will not provide any feed for game animals at the hunting site. The owners of the feeders will be financially responsible for repairs to the feeders. 8. The purchaser may erect and operate scouting cameras at his own discretion within the defined area around his hunting site. If desired, the rancher will assist the hunter in downloading and forwarding images from scouting cameras. 9. Purchaser shall have the option of use of “the old ranch cabin” which may include other parties, or use water and electricity R. V. hookups provided by the ranch. 10. Access to the ranch shall be limited to no more than 40 days per calendar year including both hunting and non-hunting visits. 11. This agreement shall be binding upon the heirs of each party. 12. The rancher shall be notified by email or phone call the day before each ranch visit in or out of season. 13. The rancher requires a complete written or email “kill report” from each visit to the ranch so that each party will be clear about the number of animal kills that remain in this agreement for each season. 14. No ATV’s will be allowed due to noise disrupting wildlife. Noiseless “golf cart type vehicles” are permitted. 15. Each individual guest who visits the ranch under this agreement will be required to sign a Hold Harmless Document from Red Creek Nature Ranch. 16. This lease agreement shall be terminated immediately, without refund, if purchaser trespasses outside of defined territory, cuts ranch fences, violates state game laws or violates the terms of this agreement. 17. The rancher must be comfortable with the purchaser both as a hunter and ranch guest. |
